Disclosures under the J&K Right to Information Act,2009

In terms of the requirements of the Section 4(b) {(i) to (xvii)} of the “The Jammu and Kashmir Right to Information Act,2009”, the following information pertaining to the Raj Bhavan, J&K, is made available on its website, for information of the general public. In case any person wishes to obtain further information relating to the functioning of this Office, he/she may contact the Public Information Officer,  Governor's Secretariat, whose particulars have been indicated separately.

 

 

Particulars of Organization, Functions and Duties
Section 4 (1) (b) (i)

 

The Raj Bhavan, the first office of the Government of Jammu & Kashmir, is the office-cum-official residence of the Head of the State i.e His Excellency the Governor, J&K. The Constitutional functions and duties of the Governor are enumerated in the Constitution of  Jammu & Kashmir. Besides, by virtue of certain legislative enactments, the Governor discharges additional responsibilities as the :
i. Chairman, Shri Mata Vaishno Devi Shrine Board;
ii. Chairman, Shri Amarnath Ji shrine Board; and the
iii. Chancellor of
      a. Shri Mata Vaishno Devi University,
      b. University of Jammu,
      c. University of Kashmir,
      d. Sher-i-Kashmir University of Agricultural Sciences and Technology, Jammu, and,
      e. Sher-i-Kashmir University of Agricultural Sciences and  Technology, Kashmir.
 

 

 

The procedure followed in the decision making process, including channels of supervision & accountability

Section 4 (1) (b) (iii)

 

(1) Constitutional and Statutory Matters:-  

The Governor, as the Constitutional Head of the State, acts on the advice of the Council of Ministers headed by the Chief Minister, save in situations provided in the Constitution of Jammu & Kashmir.  The matters requiring the Governor's consideration are processed by the concerned department of the J&K Government and, with the approval of the Minister-in-charge/Cabinet, the related proposals are submitted to the Governor by the Chief Minister, in the form of a Memorandum, in terms of the procedures laid down in the J&K Government Business Rules. Such proposals are subsequently examined in the Governor’s Secretariat and placed before the Governor for consideration/orders.

(2) Public Grievances 

On  receipt of a representation through post/person/E-mail, a report is sought from the concerned State Government Department or appropriate advice is communicated to the concerned Department, for consideration of the petitioner's request.

 

 

 

The Norms set by it for the discharge of its functions

Section 4 (1) (b) (iv)

 

The Office discharges its function under the directions / guidance of the Governor.

 

 

 

The Rules, Regulations, Instruction manuals & Records, held by it or under its control or used by its employees for discharging its functions

 

Section 4 (1) (b) (v)

 

In the discharge of its functions the Governor's Secretariat is required to refer, interalia, to the Indian Constitution, Constitution of Jammu & Kashmir, the Jammu & Kashmir Government Business Rules, J&K Classification, Conduct and Appeal Rules,  J&K Civil Service Regulations, and such other Acts and/or Regulations (issued by the State Government from time to time) as may be relevant to the examination of a given matter.

 

 

Statement of categories of documents that are held by it or under its control

Section 4 (1) (b) (vi)

 

In regard to the approvals granted by His Excellency the Governor regarding the amendments of Statutes, Regulations and Ordinances of the Universities or in respect of the appointment of University teachers, the information would be available with the Registry of the concerned University. Information in regard to the approvals / orders on papers/ files relating to the functioning of the Legislature/ State Government/ Shrine Boards would be available in the records of the Legislature or the concerned State Government Department/Shrine Board(s) concerned.

The following important documents are, inter alia, maintained in the Raj Bhavan.

·     Warrant of appointment of Governors.

·     Papers related to appointment of Chief Minister, and Ministers, and their Oath of Office.

·     Oath or Affirmations of Office administered by the Governor to high dignitaries such as  Chief Justice of J&K High Court, Chairman of the J&K Public Service Commission, State Chief Information Commissioner and State Information Commissioners, Chairperson and Members of the State Accountability Commission etc.

·     Papers related to appointment of the Vice Chancellors of various Universities

·     Reports received from State Government Departments in regard to representations/petitions  received at Raj Bhavan.

·     Personal files of Raj Bhavan employees.

 

 

The particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof

Section 4 (1) (b) (vii)

The Governor is the Constitutional Head of the State. He receives representations / applications from the general public for the redressal of their grievances relating to policies / actions of the State Government. These are forwarded to the concerned Department of the State Government for appropriate consideration / action. As regards Constitutional matters, the Governor discharges his functions as per the Constitution and on the advice of the Council of Ministers excepting matters under his discretion.

Section 4 (1) (b) (xv)

 

The Office does not deal directly with public. However, members of the public are free to meet the Governor on any working day, with prior appointment. The public also make complaints through post, E-mail, representations or meetings (with prior appointment) regarding their grievances, which are generally referred to the State Government for report/appropriate action.
